Europe and America
European Union
On July 15, 2022, the European Chemicals Agency (ECHA) proposed to add medium-chain chlorinated paraffins (MCCP) and other substances with carbon chain lengths ranging from C14 to C17 to the restricted substances list in the EU REACH Regulation (EC) No 1907/2006 Appendix XVII, in order to restrict the manufacture, use and placement on the market of substances, mixtures and articles containing such substances. This proposal is still at an early stage and needs to be evaluated by the ECHA's Risk Assessment Committee (RAC), the Social and Economic Analysis Committee (SEAC), and the European Commission. Once the assessment is passed, this restriction requirement will be issued in the form of the REACH Regulation Appendix XVII restriction requirements.
The United States
Recently, two states in the United States have respectively passed legislation to regulate per- and polyfluoroalkyl substances (PFAS) in consumer products. On June 3, 2022, Governor Jared Polis of Colorado signed HB22-1345, which established a regulatory plan to prohibit the production or sale of certain products that intentionally contain PFAS substances, including floor mats, fabric treatments, food packaging, infant products, oil and gas products, kitchenware, cosmetics, indoor and outdoor fabric decorations, and indoor and outdoor soft furniture. Additionally, this plan requires manufacturers to report and label cookware that contains intentionally added PFAS chemicals. On June 7, 2022, Governor David Ige of Hawaii approved HB 1644. The main content of this plan is to prohibit the production, sale, or distribution of packaging and padding, plates, food trays, and pizza boxes that contain PFAS, as well as to prohibit the production, sale, distribution, and use of B-grade fire-fighting foam containing PFAS (with certain exemptions). In recent years, as the harmfulness of more and more PFAS substances has been confirmed, the global regulatory heat for such substances has been continuously rising. Several states in the United States have been formulating or have already introduced regulatory requirements for PFAS in consumer products. Relevant enterprises exporting to the United States must pay sufficient attention.
